Things to consider in agreements

Open utilisation of the materials collected and the results generated by the project requires a foundation to be established at the outset.

These conditions are created by:

  • agreeing on ownership of the data, responsibility for its storage and rights of use.
  • Taking into account data protection legislation, confidential and sensitive information must be considered.
  • The research subjects must be informed about the use of the collected data, and permission must be obtained for the storage and disclosure of the data.
  • Agreeing to use open publication channels for publishing the results.
  • Agreeing on who decides the place and time of publication of the data and results.
  • Agree on the resources for storing and disclosing the data.
  • Comply with the instructions and requirements provided by the funder.
  • Inform the research subjects about the use of the collected data and obtain permission for storing/disclosing the data.
  • The above issues must be taken into account in the data management plan, the project letter of intent and the subsequent cooperation agreement.

The agreements may, for example, stipulate the following: 'The parties to the agreement shall endeavour to publish the research data generated in the project in accordance with the principles of open publication, and make the research data available to all. Openness does not apply to confidential or otherwise secret information of the contracting parties or background material.'
